Tratando-se de um problema resultante da confronta\u00e7\u00e3o da realidade com a legisla\u00e7\u00e3o existente, sobre o qual n\u00e3o h\u00e1 literatura anterior significativa e as possibilidades de quantifica\u00e7\u00e3o s\u00e3o escassas, recorreu-se a dois procedimentos dominantes: observa\u00e7\u00e3o da realidade versus dispositivos legais; entrevistas com entidades e especialistas relacionados com as problem\u00e1ticas em apre\u00e7o. Contudo, formuladas as hip\u00f3teses de causas explicativas, constatou-se que a sua averigua\u00e7\u00e3o n\u00e3o poderia passar pela an\u00e1lise de casos ou observa\u00e7\u00e3o directa dos intervenientes no licenciamento e na fiscaliza\u00e7\u00e3o. Por isso se utilizaram m\u00e9todos indirectos. A ilegalidade de parte da publicidade exterior junto \u00e0s estradas nacionais resulta de preocupa\u00e7\u00f5es de seguran\u00e7a rodovi\u00e1ria (DL n\u00ba 13\/71) e de preserva\u00e7\u00e3o ambiental (DL n\u00ba 105\/98), havendo concord\u00e2ncia nos valores a preservar, embora haja diferen\u00e7as quanto \u00e0 responsabiliza\u00e7\u00e3o, autoriza\u00e7\u00e3o e fiscaliza\u00e7\u00e3o. Tal facto, as frequentes altera\u00e7\u00f5es legislativas, a terminologia utilizada e alguns acord\u00e3os exigiram uma an\u00e1lise que confirmou o que se suspeitava, e permitiu precis\u00f5es indispens\u00e1veis \u00e0 tipifica\u00e7\u00e3o da realidade. Constatada a exist\u00eancia de consequ\u00eancias socialmente relevantes (maior probabilidade de sinistralidade, degrada\u00e7\u00e3o ambiental, concorr\u00eancia desleal e degeneresc\u00eancia \u00e9tica)e visando uma solu\u00e7\u00e3o parcial, mas imediata, do problema, apresenta-se um conjunto de sugest\u00f5es de altera\u00e7\u00e3o das pr\u00e1ticas e do quadro legal. Ficou por analisar de uma forma mais sustentada a eventual rela\u00e7\u00e3o entre financiamento informal das campanhas eleitorais aut\u00e1rquicas e a prolifera\u00e7\u00e3o da publicidade exterior ilegal.<\/p>\n<p style=\"text-align: justify;\"><a id=\"resumo\" href=\"http:\/\/obegef.pt\/images\/gf_php\/gfindex.php?p=f&amp;publ=wp028\" target=\"resumo\" name=\"resumo\"><br \/>\n<\/a><a href=\"http:\/\/obegef.pt\/wordpress\/wp-content\/uploads\/2009\/01\/en.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-11 alignleft\" alt=\"Texto em ingl\u00eas\" src=\"http:\/\/obegef.pt\/wordpress\/wp-content\/uploads\/2009\/01\/en.jpg\" width=\"25\" height=\"25\" \/><\/a><strong><\/strong>This text is the beginning of the answer to a question posed upon noticing that a large amount of the outdoor advertising alongside national motorways is illegal: how is this occurrence justifiable? Given this is a problem that stems from a clash between reality and the legislation in force, on which no previous significant writings exist and quantification possibilities are few, two main procedures were adopted: observation of reality versus legal provisions and interviews with specialists on the subjects at hand. However, after formulating the explanatory hypotheses it became evident that no case analysis or direct observation of the actors involved in licensing and enforcement was possible. Indirect methods were therefore used. The illegal nature of some of the outdoor advertisements found alongside national motorways finds its basis both from road safety (DL no. 13\/71) and from environmental protection (DL no. 105\/98) concerns. Despite agreement on the values requiring safeguarding, there are differences as regards liability, permits and enforcement. This fact, along with frequent legislative changes, the terminology used and different legal decisions, demanded an analysis that confirmed initial suspicions and allowed for the precisions required when typifying reality. After identifying the existence of socially relevant consequences (increased probability of accidents, environmental hazard, illegal competition and ethical\/moral hazard) a set of recommendations with regard to current practice and the legal framework is presented, with the aim of providing a partial but immediate solution to the problem.
