\"textoNeste texto tenta-se propor um crit\u00e9rio de reconhecimento da criminalidade econ\u00f3mico-financeira. Indicam-se alguns aspectos de contacto e de distanciamento entre essa realidade e a da criminalidade organizada, em que o crime de corrup\u00e7\u00e3o se assume como figura tipol\u00f3gica de conflu\u00eancia entre as duas. Procura-se elencar o acervo normativo, no \u00e2mbito do ordenamento penal e processual penal avulso, tendente a potenciar a preven\u00e7\u00e3o e o combate \u00e0 criminalidade econ\u00f3mico-financeira, a\u00ed se surpreendendo algumas descontinuidades que, porventura, n\u00e3o favorecem uma interven\u00e7\u00e3o adequada sobre os fen\u00f3menos que visam controlar. Observam-se as dificuldades de defini\u00e7\u00e3o legal de conceitos como criminalidade econ\u00f3mico-financeira e organizada, que derivam, compreensivelmente, nalguma medida, da pr\u00f3pria ambiguidade das categoriza\u00e7\u00f5es criminol\u00f3gicas e sociol\u00f3gico-culturais que n\u00e3o encontram uma caracteriza\u00e7\u00e3o un\u00edvoca e est\u00e1vel. Ensaia-se uma abordagem do que pode vir a ser uma metodologia mais adequada e eficiente de interven\u00e7\u00e3o eminentemente judici\u00e1ria sobre o fen\u00f3meno da criminalidade econ\u00f3mico-financeira, centrando-se sobre a eventual reconfigura\u00e7\u00e3o do papel e formas de interven\u00e7\u00e3o das principais institui\u00e7\u00f5es de preven\u00e7\u00e3o e investiga\u00e7\u00e3o criminal (v.g., entidades de supervis\u00e3o e regula\u00e7\u00e3o, departamentos inspectivos da Administra\u00e7\u00e3o P\u00fablica, o Conselho de Preven\u00e7\u00e3o da Corrup\u00e7\u00e3o, o Minist\u00e9rio P\u00fablico \u2013 o DCIAP e a Pol\u00edcia Judici\u00e1ria \u2013 a UNCC). Abordam-se, ainda, as pr\u00e9-compreens\u00f5es e as poss\u00edveis formas de interven\u00e7\u00e3o dos actores institucionais mais directamente envolvidos no combate \u00e0 criminalidade econ\u00f3mico-financeira. Aceitando a centralidade da corrup\u00e7\u00e3o como fen\u00f3meno de conflu\u00eancia entre a criminalidade econ\u00f3mico-financeira e a criminalidade organizada, procura-se analisar o conjunto de pressupostos em que se pode alicer\u00e7ar um modelo alternativo de seguran\u00e7a e de controlo das pr\u00e1ticas corruptivas.<\/p>\n

\"TextoThis paper attempts to propose a criterion for recognition of economic and financial crime. Some aspects of contact and gap between this reality and organized crime are focused, wherein the crime of corruption is assumed as the typological figure of confluence between those two realities. We try to list the legal standards, within the criminal and procedural loose system, tending to enhance the prevention and fight against economic and financial crime, surprising some discontinuities that perhaps do not favor an appropriate intervention on the phenomena they seek to control. We note the difficulties of legal definition of concepts such as economic and financial crime and organized crime, derived, understandably, to some extent, from the very ambiguity of criminological and sociological-cultural categories which characterization is not univocal and stable. An approach of what may be an appropriate and efficient methodology eminently judiciary intervention on the phenomenon of economic and financial crime is assayed, focusing on the possible reconfiguration of the role and terms of intervention of the major institutions on preventing and criminal investigation (v.g., supervisory and regulatory authorities, inspective departments of Public Administration, the Council for Prevention of Corruption, the Public Prosecution Office - the DCIAP and Judiciary Police - the UNCC). It is also tested the pre-understandings and possible terms of intervention of institutional actors most directly involved in the fight against economic and financial crime. Accepting the centrality of corruption as a confluence phenomenon between economic and financial crime and organized crime, we seek to analyze the set of assumptions that can base an alternative model of safety and control of corrupting practices.<\/p>\n
