Em todo o caso, permaneceram \u201cdormentes\u201d na investiga\u00e7\u00e3o acad\u00e9mica at\u00e9 aos desenvolvimentos proporcionados pela investiga\u00e7\u00e3o seminal de Becker, 1968, \u201cCrime and Punishment: An Economic Approach\u201d.
\nNo contexto da Economia das Pescas, o problema pode ser entendido como uma externalidade que resulta da dif\u00edcil defini\u00e7\u00e3o dos direitos de propriedade e dos custos associados \u00e0 fiscaliza\u00e7\u00e3o e imposi\u00e7\u00e3o da sua exclusividade. O problema torna-se mais complexo dadas as caracter\u00edsticas transzonais de certas esp\u00e9cies pisc\u00edcolas.
\nO artigo combina o Modelo B\u00e1sico de Gest\u00e3o das Pescas (Gordon\/Schaefer) com a teoria do Crime e Castigo de Becker para abordar o tema dos designados \u201cinterlopers\u201d (utilizadores indesejados) nas pescarias do Alto-Mar. Os \u201cunfinished business\u201d da lei do Mar (segundo a express\u00e3o de G. Munro), i.e., a incompleta defini\u00e7\u00e3o dos direitos de uso nas \u00e1reas para l\u00e1 do limite das Zonas Econ\u00f3micas Exclusivas, estiveram na origem de v\u00e1rias \u201cfish wars\u201d, nos anos 90, e motivaram a realiza\u00e7\u00e3o da Confer\u00eancia das Na\u00e7\u00f5es Unidas sobre Gest\u00e3o de Recursos Transzonais e Esp\u00e9cies Altamente Migradoras cujos resultados encontramos consubstanciados no Acordo respetivo, de 1995. Contudo, com as regras processuais que s\u00e3o propostas em termos de fiscaliza\u00e7\u00e3o, o efeito potencial deste Acordo parece estar altamente limitado.<\/p>\n

\"Texto<\/a>Illegal behaviour and public enforcement of law are important theoretical and empirical subjects for Economics. They were dormant in economic scholarship, until the article of Becker, 1968, \u201cCrime and Punishment: An Economic Approach\u201d.
\nIn the context of Fisheries Economics, the problem can be seen as an externality arising when exclusive property rights are absent. That absence depends on the costs of defining and enforcing exclusivity and the problem becomes more complex when fisheries are transboundary.
\nThe paper combines standard Economics of Fisheries analysis with the Theory of \u201cCrime and Punishment\u201d. The conclusions are used to discuss the so-called issue of \u201cinterlopers\u201d in High Sea fisheries. The \u201cunfinished business\u201d of the Law of the Sea, that is, the imprecise definition of property rights in the areas of High Sea adjacent to Economic Exclusive Zones, were in the origin of a lot of \u201cfish wars\u201d in the nineties. The 1995 UN agreement on transboundary stocks and highly migratory species pretended to be a new form of cooperation, including the introduction of new forms of enforcement and compliance with the law, affecting fishing enterprises and convenience-flag vessels. However, with the legal procedures that were proposed, it seems broadly bounded, the potential effect of enforcement and regulation.<\/p>\n
